General Privacy

Education 4 Kids® requests certain specific information from our customers in order to perform business operations in the store. This information is, unless otherwise noted, not shared with any parties.

Payment Processing

In the process of purchasing products from Education 4 Kids® (placing an non BASIC advertisement) you will be asked to complete the purchase via paypal. Payment data is NOT stored on Education 4 Kids® in any way, shape or form. Your transaction process is between you and paypal.

Account Information

When you create an account at SOLD! @ Edu$Kids (Education 4 Kids®) you will be asked for specific information. This includes your name, address and contact information. This information will be stored in the Education 4 Kids® database. This information IS NOT SHARED.

Purchasing History

Unfortunately, the USA PATRIOT Act as passed by the United States Congress states that I may be required to provide information about your purchasing history to the United States Federal Government (in fact every on-line store in the US is affected by this, though most will not tell you). According to the Act, if they request my records, I am not permitted to advise you of such and I must comply with the law. Additionally, if required by a subpoena from any branch of the government, we will have to comply in providing the information that they request. This information is not limited to your account information and may also include your purchasing history. We do not like this any more than you do, but there is nothing that we can do about it (feel free to complain to the Attorney General or any of the 99 US Senators that voted for the Act).

Yes, we use cookies on the store. It's how we know who you are and how we maintain state. The cookies we use can only be recovered by this site and are used strictly to maintain transactional state. There is no purchasing information maintained within the cookies that we use.

COPPA

SOLD! @ Edu4Kids, in compliance with the Children's Online Privacy Protection Act (COPPA) of 1998, provides notice to parents of children under 13 that this site is not designed to do business with children. In order to do business on this site with Education 4 KIds, Inc. you must have a paypal account. Based on this assumption, we do not anticipate requiring any of the limitations to Account Creation information provided as being provided by a child. Unfortunately we are aware that a child may create an account and provide their information. Since we do not share that information the information stays on our servers only. If a parent has found that a child has created an account, they can contact us via our Contact Us page and request that the account be removed from the system. After we validate the account was created by a child, the account will be deactivated.

USA Patriot Act

On December 13th 2003 US President George W. Bush signed into law portions of the expanded USA Patriot Act (Intelligence Authorization Act for Fiscal Year 2004). The Act included a simple, yet insidious, redefinition of "financial institution," which previously referred to banks, but now includes stockbrokers, car dealerships, casinos, credit card companies, insurance agencies, jewelers, airlines, the U.S. Post Office, and any other business "whose cash transactions have a high degree of usefulness in criminal, tax, or regulatory matters." In other words, even though I claim that you have privacy, the US Federal government can demand that I supply your information to them at any time, without a warrant, and that I can not tell you or I will face criminal prosecution (yes, those are really the rules). Actually, if you read the law you have no privacy. We just wanted to make sure that you were aware of it and that we have no control over it at all. So, besides that, we will continue to do all we can to protect your privacy in every other way.

When you visit Education 4 Kids® or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. All items purchased from SOLD! @ Edu4Kids (Education 4 Kids® user classified advertisements) are made directly between you and the user advertiser who created the classified. Education 4 Kids, Inc. is not a partner of the advertisers and is in no way associated to them other than providing the classified advertiser the ability to create and post a classified advertisement at the domain sold.edu4kids.com. This means that the risk of loss and title for any transactions between you and any advertiser using the sold.edu4kids.com domain for placing a classified advertisement is between you and that individual or company that placed the advertisement and does not have anything to do with Education 4 Kids, Inc.

PRODUCT DESCRIPTIONS

Education 4 Kids® attempts to be as accurate as possible. However, Education 4 Kids® does not warrant that product descriptions or other content within the sold.edu4kids.com domain in any advertisement placed by any user as accurate, complete, reliable, current, or error-free. APPLICABLE LAW

DISPUTES

Any dispute relating in any way to your visit to Education 4 Kids® or to products you purchase through Education 4 Kids® shall be submitted to confidential arbitration at JAMS (Judicial and Arbitration Mediation Service) in Orange County, California, except that, to the extent you have in any manner violated or threatened to violate Education 4 Kids® intellectual property rights, Education 4 Kids® may seek injunctive or other appropriate relief in any state or federal court in the state of California County of Orange, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of JAMS or the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

REFUNDS FOR ADVERTISEMENTS

Advertisements placed on sold.edu4kids.com are non-refundable.

URL ADVERTISEMENTS

Education 4 Kids, Inc. does not permit advertisements from competitor web sites on the sold.edu4kids.com classified advertising. A competitor web site is one that sells retail or discount retail products to end consumers and sells more than 20 (twenty) individual products at the website URL linked to, or if the URL links to a competitor website. URL advertisements that link to competitor websites (or have a link to a competitor website at the URL that is on sold.edu4kids.com) may be dropped from the listing without refund and the user who posted may be banned.

USER BANNING

Education 4 Kids, Inc. reserves the right to ban users who violate the terms and conditions. Users who are banned may have all running advertisements removed. Refunds for removed advertisements for banned users will not be made.

PAYMENTS

Education 4 Kids, Inc. process all payments made for advertisements on sold.edu4kids.com through paypal.
